1. PROMOTIONAL PRODUCTS, PARTICIPATING RETAILERS, PROMOTIONAL PERIOD, AND PARTICIPANTS

1.1. This promotion is a Canon Canada Inc. (“Canon”) promotion and only available on purchases made of any of the products listed below in Schedule 1 (the “Promotional Products”) within Canada from one of our participating retailers and as set out at Schedule 2 (“Participating Retailers”) between 00:00 Friday, April 12, 2024 and 23:59 Thursday, June 27, 2024 inclusive (the “Promotional Period”). All other products and retailers are excluded. Some Promotional Products may be sold as a camera or printer only or part of a bundle but only THREE claims can be made per household. Purchases must be genuine purchases for cash or its equivalent. Only Promotional Products sold by Participating Retailers are eligible for this promotion. Some Participating Retailers may operate marketplaces that allow other sellers to sell their products. Products purchased on these marketplaces are not eligible for this promotion. In addition, Promotional Products purchased through an enterprise commercial sales program are ineligible for this promotion.  Any attempt to gain participation in this promotion without satisfying the requirements mentioned above shall be deemed invalid as determined by Canon in its sole discretion.

1.2. All Participants must be aged 18 or over and must be resident in Canada (“Participant”).

1.3. All Participants are deemed to have agreed to be bound by these terms and conditions.

1.4. All Promotional Products must be new and genuine Canon Products. Purchases of second hand, refurbished or reconditioned products, or products which are counterfeit or infringe the intellectual property rights of the Canon group of companies in any way (for example, including but not limited to parallel or “grey” products) will not qualify under this promotion.

 

2. HOW TO PARTICIPATE

2.1. To enter the cashback promotion, the Participant must purchase a Promotional Product or Products from a Participating Retailer during the Promotional Period within Canada AND submit a valid claim online between 00:00 Friday, April 12, 2024, and 23:59 Sunday, August 11^th.

2.2. Claims must be submitted by fully and correctly completing (including specifying a valid product serial number) a claim form online, at www.canoncreatorlab.ca/offers for a Promotional Product purchased within Canada. Participants will need to scan, upload and attach to the online claim form a copy of their receipt, or order confirmation for internet purchases.  Participants will then receive an email confirming that their claim has been received.  If you do not receive a confirmation email within 24 hours of processing your claim or do not have access to a computer, please contact our Claim Hotline on 1-800-OK-CANON

2.3. The Promotional Products are subject to availability while stocks last. Canon will not be liable for the failure of retailers to fulfill orders of Promotional Products during the Promotional Period.

2.4. Canon will not process any claims received after the closing date of 23:59 Sunday, August 11^th. Canon will not process claims which are in its opinion incomplete or illegible. Canon will not be responsible for claims delayed or not successfully received.

2.5. Claims by businesses or individuals who make bulk purchases (being more than 3 Promotional Products within more than 3 separate registrations during the Promotional Period other than where the relevant products are comprised in kits or bundles as described in clause 1.1) will not be eligible to enter this Promotion.

 

3. CASHBACK

3.1. Participants will receive Cashback as set out in Schedule 1 in the amounts shown for purchases of Promotional Products.

3.3. Upon receipt and verification of the claim, Canon will arrange for a direct BACS transfer payment to the Participant’s bank account. No alternative arrangement will be entered into and no cash or cheque will be provided.

3.4. Canon will endeavor to transfer via BACS within 4-6 weeks of receipt of a complete and valid claim.

3.5. Only one BACS payment will be issued per valid claim.

3.6 Canon Canada Inc only accepts claims with banks that have been underwritten by the Canadian Deposit Insurance Corporation. To confirm that your bank is one of them, visit: https://www.cdic.ca/your-coverage/list-of-member-institutions/

 

4. THE PROMOTER

4.1. The promoter is Canon with its registered office address at 8000 Mississauga Road, Brampton, ON L6Y 5Z7.

 

5. DISCLAIMERS

5.1. To the fullest extent permitted by law, Canon shall not be liable for any loss, damage or injury of any nature howsoever caused, sustained by any Participant under this promotion. However, nothing in these rules shall have the effect of excluding or restricting Canon’s liability for personal injury or death caused by the proven negligence of Canon’s employees or agents.

5.2. In exceptional circumstances, Canon may void, amend, and/or change this promotion at any time without incurring any liability whatsoever provided that such changes are necessary and can be justified by objective reasons.

5.3. Canon reserves the right to audit any claims to ensure compliance with these terms and conditions and to request additional information and supporting documents. Canon reserves the right to exclude claims and/or Participants if it suspects that the promotion is being abused in any way. Canon’s decisions in relation to the promotion are final and no correspondence will be entered into.

5.4. If any part of these conditions is found by a court of competent jurisdiction or other competent authority to be invalid, unlawful or unenforceable, then such part shall be severed from the remainder of these conditions, which shall continue to be valid to the fullest extent permitted by law.

5.5  Canon, its associated companies, affiliates, suppliers, advertising/promotion agencies, and any other entity or entities involved in the development, production, administration or fulfillment of this promotion, and each of their respective agents, employees, directors, successors, and assigns (collectively, the “Released Parties”) will not be liable for: (i) any failure of the Canon website or any other site during this promotion; (ii) any malfunctions or other problems of any nature whatsoever, including, without limitation, those relating to the telephone network or lines, computer on-line systems, servers, access providers, computer equipment or software; (iii) the failure of any Promotional Product registration, opt-in and/or other information to be received, captured or recorded for any reason whatsoever, including, but not limited to, technical problems or traffic congestion on the internet or at any website; (iv) any injury or damage to a Participant’s or any other person’s computer or other device related to or resulting from participating in this Promotion; and/or (v) any combination of the above.

5.6  By participating in this promotion, each Participant hereby: (i) confirms compliance with these terms; (ii) releases the Released Parties from any and all liability in connection with this promotion and his/her participation therein; and (iii) agrees to the publication, reproduction and/or other use of his/her name, statements about the promotion and/or photograph or other likeness without further notice or compensation, in any publicity or advertisement carried out by or on behalf of Canon in any manner whatsoever, including print, broadcast or the internet.

 

6. DATA

6.1. By participating in this promotion, each Participant expressly consents to Canon, its agents and/or representatives, storing, sharing and using any personal and other information submitted only for the purpose of administering the promotion and in accordance with Canon’s privacy policy (available at the link below).  This section does not limit any other consent(s) that an individual may provide Canon or others in relation to the collection, use and/or disclosure of their personal information. Canon is the Data Controller in respect of any personal data supplied by Participants. Any personal data submitted to Canon will be processed by (a) Canon and its third party supplier Benamic Ltd, IDA Business and Technology Park, Ring Road, Kilkenny, Ireland, for the purpose of administering this promotion, and, if applicable (b) by Canon and its associated companies for marketing purposes- in cases where Participants have opted-in to receive marketing communication from Canon. 6.2. If Participants do not wish for their contact information to be used for marketing purposes or to enable Canon to contact them in the future regarding similar promotions, they should NOT check the relevant “opt-in” box when completing the claim form.

7. LAW ANDJURISDICTION

This promotion shall be interpreted and enforced in accordance with the laws of the Province of Ontario and the laws of Canada applicable therein.  The forum for any disputes relating to this promotion shall be the Province of Ontario and you agree to attorn to the courts in the Province of Ontario and they agree that all legal proceedings in respect of this promotion shall be commenced and maintained only in the courts of the said province.
